TERMS OF USE

1. AGREEMENT TO TERMS OF USE

1.1. These Terms and Conditions of Use (the “Terms of Use”) govern access to and use of Boost Bank Berhad (Registration No. 202301007223 (1510114-T)) (“Boost Bank”) digital channels, including its web site located at www.myboostbank.co and www.myboostsme.co (collectively, “Site”), mobile application (“App”), any related digital channels (collectively, the “Digital Channels”). These Terms of Use apply separately from, and in addition to, the terms and conditions governing any products or services you take up from Boost Bank.

1.2. BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE DIGITAL CHANNELS, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO BE BOUND BY THESE TERMS OF USE.

1.3. Acceptance of these Terms of Use may be effected electronically, including by ticking a box, clicking an acceptance button, registering an account, or continuing to access or use the Digital Channels after these Terms of Use are made available to you.

1.4. Electronic records maintained by Boost Bank, including system logs and acceptance records, may be used as evidence of your acceptance and use of the Digital Channels.

1.5. IF YOU DO NOT AGREE TO THESE TERMS OF USE, YOU MUST NOT ACCESS OR USE THE DIGITAL CHANNELS.

1.6. These Terms of Use apply whether or not you subsequently apply for, are approved for, or maintain any product or services with Boost Bank.

2. RELATIONSHIP WITH PRODUCT TERMS

2.1. These Terms of Use govern how you access and use the Digital Channels only.

2.2. Any product or service that you apply for, are approved for, or maintain with Boost Bank or any third-party provider or affiliate accessible through the Digital Channel may be governed by separate product-specific terms and conditions (the “Product Terms”), which will apply in addition to these Terms of Use.

2.3. Your acceptance of these Terms of Use does not, by itself means that you have applied for or agreed to any Product Terms. You will be asked to review and accept the relevant Product Terms or applicable third-party or affiliate terms before you take up a product or service.

2.4. In the event of any inconsistency: (a) the applicable Product Terms shall prevail in respect of the relevant product or service and (b) these Terms of Use shall prevail in respect of access to, and use of, the Digital Channels.

3. FAIR TREATMENT, TRANSPARENCY AND CONSENT

3.1. Where the Digital Channels display product information, Boost Bank will make available relevant fees and charges, key features and key contractual terms, and contact channels for enquiries or complaints, before you enter into a contract for a product or service.

3.2. Any consent for marketing or data sharing will be requested separately and can be managed through the Digital Channels (where available) or through the channels published by Boost Bank.

3.3. If you require assistance using the Digital Channels (for example due to accessibility needs), you may contact Boost Bank through the support channels specified under Clause 18 below .

4. MODIFICATION OF TERMS

4.1. Boost Bank may amend these Terms of Use from time to time. Where changes are material, Boost Bank will where practicable provide you with advance notice through the Digital Channels and other reasonable means. However, Boost Bank may implement changes immediately where this is necessary for security, fraud prevention, system integrity or to comply with law or regulatory requirements.

4.2. IF YOU DO NOT AGREE TO THE AMENDED TERMS OF USE, YOU SHOULD STOP USING THE DIGITAL CHANNELS. YOUR CONTINUED USE OF THE DIGITAL CHANNELS AFTER THE AMENDED TERMS OF USE ARE MADE AVAILABLE TO YOU WILL CONSTITUTE ACCEPTANCE OF THE AMENDED TERMS OF USE.  

5. ACCESS TO THE DIGITAL CHANNELS AND TECHNOLOGY NEUTRALITY

5.1. Boost Bank grants you a limited, non-exclusive, non-transferable and revocable licence to access and use the Digital Channels for your own personal or business purposes only.

5.2. The Digital Channels are provided on an electronic basis and may be accessed through various devices, operating systems and technologies approved by Boost Bank from time to time.

5.3. Boost Bank may introduce, modify, replace or discontinue any features, functions, interfaces, security mechanisms used to access the Digital Channels. Where a change materially affects your ability to access essential account functions, Boost Bank will where practicable provide advance notice or provide an alternative channel, subject to applicable law and regulatory requirements.

5.4. Boost Bank does not guarantee that the Digital Channels will be compatible with all devices, operating systems or software versions. For security and system integrity, Boost Bank may require minimum device and operating system standards and may restrict certain functionality until you update your device or software.

6. PRIVACY AND COMMUNICATIONS

6.1. Boost Bank’s collection, use, disclosure, and processing of personal data and sensitive personal data are governed by Boost Bank’s Privacy Notice (“Privacy Notice”) available at www.myboostbank.co/privacy-notice or such other webpage, URL, or platform as Boost Bank may designate from time to time. The Privacy Notice forms part of the documentation provided to you during registration and remains accessible via the Digital Channels.

6.2. Where you access or apply for products or services provided by third-parties or affiliates through the Digital Channels, your personal data may also be subject to the privacy notices and terms of such third-party providers or affiliates.
 
7. REGISTRATION, ACCURACY OF INFORMATION AND AUTHORITY

7.1. You must ensure that all information you provide through the Digital Channels is accurate, complete and kept up to date.

7.2. Where you act on behalf of a company, partnership, sole proprietorship or other entity, you represent and warrant that you have the authority to (a) bind the entity to these Terms of Use and (b) apply for and operate any products or services in accordance with applicable Product Terms.

8. INTELLECTUAL PROPERTY RIGHTS

8.1. The Digital Channels and all proprietary content, including trademarks, service marks, brand names, logos and other intellectual property are the property of Boost Bank or its licensors.

8.2. You may use the Digital Channels for, where applicable, your own personal or business purposes only. You must not copy, modify, distribute, reverse engineer, decompile or create derivative works from the Digital Channels, except to the extent permitted by applicable law or with Boost Bank’s prior written consent.

8.3. Unless otherwise stated, you are not permitted to use, reproduce, alter, display, adapt, distribute, or publish any part of the content on the Digital Channels without our prior written approval and consent. You may print, and download extracts, of any page from the Digital Channels for your personal use only. However, you must not modify the paper or digital copies of any materials you have printed or downloaded in any way, nor use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text and shall acknowledge that the content is taken from the Digital Channels (or from any identified contributors as the authors of the content). If you print, copy, download, share or repost any part of the Digital Channels, in breach of these Terms of Use, we may take action in accordance with the “Termination or Suspension” section, and you must return or destroy any copies of the materials you have made.  

9. DISCLAIMERS

9.1. Boost Bank does not promise that the Digital Channels and/or any content, product, service or feature of the Digital Channels will be error-free, continuously available or uninterrupted, nor does it ensure that any defects will be corrected, or that your use of the Digital Channels will yield specific results. The Digital Channels and its content are provided on an “as-is” and “as-available” basis. All information provided on the Digital Channels is subject to change without notice. Boost Bank cannot ensure that any files or other data you download from the Digital Channels will be free of viruses or contamination or destructive features. Boost Bank expressly disclaims all warranties, whether express or implied, including any warranties of accuracy, non-infringement, merchantability and fitness for a particular purpose. Furthermore, Boost Bank disclaims any and all liability for the acts, omissions and conduct of any third-parties or affiliates in connection with or related to your use of the Digital Channels and/or any of the products and services. You assume full responsibility for your use of the Digital Channels and any of the products and services.  

9.2. The above disclaimer applies to any damages, liabilities or injuries caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use, regardless of whether it arises from breach of contract, tort, negligence or any other cause of action.

9.3. Boost Bank reserves the right to do any of the following, at any time, with advance notice: (a) to modify, suspend or terminate operation of or access to the Digital Channels or any portion of the Digital Channels, for any reason; (b) to modify or change the Digital Channels or any portion of the Digital Channels, and any applicable policies or terms; and (c) to interrupt the operation of the Digital Channels or any portion of the Digital Channels, as necessary to perform routine or non-routine maintenance, error correction, or other changes. Any termination or suspension of access to the Digital Channels is governed by the “Termination or Suspension” section.

10. LIMITATION OF LIABILITY

10.1. Except where prohibited by law, in no event will Boost Bank be liable to you for any loss of profits, sales, business, or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill, or reputation; or any indirect, consequential, exemplary, incidental or punitive damages, from your access or use of the Digital Channels.  

10.2. If, notwithstanding the other provisions of these Terms of Use, Boost Bank is found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the Digital Channels, Boost Bank’s liability shall in no event exceed any fees Boost Bank received from you in relation to the products and services.

10.3. Boost Bank reserves the right to withdraw or withhold any products and services it may offer to you if Boost Bank is not fully satisfied with the information provided by you or any verification required by Boost Bank is not completed and Boost Bank shall not be liable for any loss or damages arising therefrom.

11. INDEMNITY

11.1. You agree to indemnify and hold Boost Bank and its officers, directors, employees, agents, subsidiaries and affiliates, harmless from losses, liabilities, claims and expenses (including reasonable legal fees), arising from your breach of these Terms of Use or misuse of the Digital Channels.

12. KEEPING ACCOUNT INFORMATION SAFE AND SECURE

12.1. Certain features, products or services offered on or through the Digital Channels may require you to create an account and password. If you have created or provided, or we have provided you with, any user identification, unique identifier, password, personal identification number, one-time passcode, Biometrics or equivalent, as part of our security procedures, you are advised to treat such information as confidential.

12.2. You are entirely responsible for maintaining the confidentiality of the information you hold for your account, including your user identification, unique identifier, password, personal identification number, one-time passcode, biometrics or equivalent, and for any and all activity that occurs under your account as a result of your failing to keep this information secure and confidential.

12.3. We may disable any access, use, account, user identification, unique identifier, password, personal identification number, one-time passcode, biometrics or equivalent, whether chosen by you or otherwise, at any time with advance notice, if we determine in our reasonable opinion that you have failed to comply with these Terms of Use.

12.4. You agree to notify Boost Bank immediately of any unauthorized use of your account or password, or any other breach of security. You may be held liable for losses incurred by Boost Bank or any other user of or visitor to the Digital Channels due to someone else using your password or account as a result of your failing to keep your account information secure and confidential.

13. THIRD-PARTY SITES, INFORMATION AND RESOURCES ARE NOT APPROVED BY US

13.1. The Digital Channels may contain links to, or enable access to, or facilitate application for third-party or affiliate applications, products, services, platforms, websites, tools or content (“Third-Party Services”). Your access to and use of such Third-Party Services are entirely at your own risk and are subject to the terms and conditions and privacy policies of the relevant third-parties or affiliates. Certain products or services accessible through the Digital Channels, including through designated webpages, paths or environments (such as www.myboostsme.co/connect), may be provided by third-parties or affiliates and subject to separate terms, conditions and privacy notices.

13.2. We do not endorse, recommend, approve or make any representations in respect of any Third-Party Services. Nothing in the Digital Channels shall be construed as creating any partnership, joint venture, agency or other relationship between us and any third-party or affiliate. Unless expressly stated otherwise, Boost Bank is not the provider of such Third-Party Services.

13.3. We do not have control over, or make no representations or warranties as to, the availability, accuracy, completeness or reliability of any Third-Party Services, the content, information or materials contained therein, or the security or integrity of such Third-Party Services. Any links are provided for your information and ease of reference only and do not imply endorsement by us.

13.4. To the fullest extent permitted by law, we shall not be liable for any loss, damage, or expense (whether direct, indirect, incidental or consequential) arising from or in connection with:

13.4.1. Your access to, use of, or application for any Third-Party Services;
13.4.2. Any act, omission, error or default of any third party;
13.4.3. Any failure, delay, interruption or inaccuracy in any data, information or transaction transmitted between us and any Third-Party Services; or 
13.4.4. Any security breach, malware, virus or harmful components arising from such Third-Party Services.

13.5. Where you consent to the sharing of your information between us and any third-party or affiliate, you acknowledge that:

13.5.1. such information may be transmitted through systems not controlled by us; and 
13.5.2. we shall not be responsible for any loss, damage or misuse of such information once it has been transmitted to the third-party or affiliate.

13.6. The Digital Channels may include information, comments and materials uploaded by other users, which have not been verified or approved by us. Such content does not represent our views, and we shall not be responsible for any such information or materials.

14. VIOLATION OF THESE TERMS OF USE AND APPLICABLE LAWS AND REGULATIONS

14.1. You represent, warrant, and undertake to comply with these Terms of Use, any applicable Product Terms and all prevailing laws and regulations, at all times, including when you access or use the Digital Channels and/or any of the products and services. Boost Bank may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your access or use of the Digital Channels or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Boost Bank’s rights or property, or the rights or property of visitors to or users of the Digital Channels, including our customers. Boost Bank reserves the right at all times to disclose any information that Boost Bank deems necessary to comply with any applicable law, regulation, legal process or governmental request. Boost Bank also may disclose your information when Boost Bank determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organisations for fraud protection purposes.

14.2. You agree that Boost Bank may, with advance notice, terminate take action in accordance with the “Termination or Suspension” section if we determine that you have violated these Terms of Use or other agreements or guidelines which may be associated with your access or use of the Digital Channels.  

15. MAINTAIN UPKEEP OF YOUR DEVICES

15.1. We cannot guarantee that the Digital Channels will always be secure, error-free, or free from malware, viruses, or other harmful components. You are solely responsible for maintaining the security of your devices (personal computers, laptops, tablets, and mobile phones) used to access the Digital Channels. This includes ensuring they are properly maintained, updated, and equipped with current antivirus and security software. You are also responsible for configuring your information technology systems, software, and platforms in a manner suitable for accessing the Digital Channels.

15.2. To the fullest extent permitted by applicable law, we shall not be liable for any loss or damage suffered or incurred by you arising directly or indirectly from (a) any restriction, limitation, suspension, or unavailability of the Digital Channels and (b) your failure to update or maintain your devices, operating systems or antivirus and security software.

16. YOU UNDERTAKE NOT TO MISUSE THE DIGITAL CHANNELS

16.1. You agree not to misuse the Digital Channels by knowingly introducing viruses, trojans, worms, logic bombs, malware and/or other material that is malicious or technologically harmful; attempt to gain unauthorised access to the Digital Channels and/or the server on which the Digital Channels is stored, any server, computer or database connected or having access to the Digital Channels and/or any devices or other users of the Digital Channels, and/or attack the Digital Channels via a denial-of service attack. In the event the Digital Channels is compromised and/or potentially compromised or any of the devices or other users of the Digital Channels are affected by your breach of the above, we may report any such breach to the relevant authorities, disclose your identity for investigation purposes, and/or take action in accordance with the “Termination or Suspension” section.

17. TERMINATION OR SUSPENSION

17.1. Boost Bank may suspend or terminate your access to the Digital Channels at any time if you breach these Terms of Use, pose a security or regulatory risk or where required by law or regulation.

17.2. Termination of the Digital Channels access does not automatically terminate your banking relationship with Boost Bank, which remains subject to applicable Product Terms.  Account closure, freezing of accounts, or restrictions on transactions are governed by the applicable Product Terms and applicable laws and regulatory requirements.

18. COMPLAINTS AND DISPUTE RESOLUTION

18.1. If you have a complaint, enquiry or require assistance in relation to the Digital Channels or any products and/or services provided by Boost Bank, you may contact Boost Bank through any of the following channels:

18.1.1. The customer support function available within the App;
18.1.2. Electronic mail to [email protected];
18.1.3. The Boost Bank’s customer support hotline: General (+603-8658 3000) or Fraud (+603-8658 3033); or
18.1.4. The online request or webform available on the Site.

Details of the above contact channels, including operating hours, may be updated from time to time and are available on the Site or App.

18.2. Boost Bank will investigate and respond to complaints in accordance with its internal policies and procedures and applicable regulatory requirements.

18.3. If your complaint is not resolved, you may have the option to refer to the dispute to external redress avenues such as the Financial Markets Ombudsman Service or BNMLINK, subject to eligibility and jurisdiction.

19. GOVERNING LAW/ REGULATORY BODIES

19.1. These Terms of Use are governed by, and construed in accordance with the laws of Malaysia.

20. MISCELLANEOUS

20.1. If any provision of these Terms of Use is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20.2. Boost Bank may assign or transfer its rights and obligations under these Terms of Use to an affiliate or successor as part of a corporate reorganisation or business transfer, subject to applicable law.

20.3. A failure by Boost Bank to enforce any right under these Terms of Use is not a waiver of that right.
